A federal judge yesterday threw out a lawsuit brought by six members of U.S. Congress that would have forced Pennsylvania election officials to institute new checks confirming eligibility and identity of soldiers, sailors and others who vote from overseas.
The lawsuit was filed by six of Pennsylvania’s eight congress representatives, including Republicans Guy Reschenthaler, Glenn G.T. Thompson, Mike Kelly and others. The other plaintiff listed in the lawsuit was PA Fair Elections. US District Judge Christopher Conner sided with the defendants, among them PA Secretary of State Al Schmidt and one of his top deputies, saying that there were no grounds to sue and the case was launched too late and too close to election day. The case had been filed in late September, when over 25,000 overseas ballots had already been sent out.
Schmidt said during comments to the media yesterday that he and the office were pleased with the dismissal of the lawsuit. Attorneys for the plaintiffs are considering their options for an appeal.
