Formal arraignments are scheduled for two of the three defendants in the murder of a Cherryhill Township couple in October, while the third suspect’s case is not yet listed in the online schedule of the county’s Court of Common Pleas.
Indiana County District Attorney Pat Dougherty on Friday filed a notice of aggravating circumstances stating that he will seek the death penalty against 19-year-old Justin Stevenson and 18-year-old Nathan Price, who are accused in the killings of Timothy J. Gardner and Jacqueline Brink at their Hillside Drive apartment. Gardner’s two young sons were in the house at the time but were not harmed.
17-year-old Isaiah Scott was with Price and Stevenson that night. Like the other two defendants, Scott is charged with two counts of criminal homicide, robbery, and conspiracy to robbery, but Scott will not face the death penalty because he was a minor at the time of the killings. Police say the three went to the apartment to buy drugs, but Price and Stevenson jumped Gardner and beat him to death with a pipe, then beat Brink to death so there would be no witnesses.
The formal arraignments for Stevenson and Price are scheduled for 1:15 PM Friday before Indiana County president Judge William Martin.
